APPLICABLE LEGISLATION

The relationships established between the owner of the website and the user will be governed by current Spanish legislation, and the competent Courts and Tribunals will be responsible for resolving any possible disputes that may arise. If the user is considered to be a consumer, the competent Courts and Tribunals will be those provided for in the provisions of current legislation governing consumer protection.

The following general terms and conditions of sale apply to the provision of guided tour services offered by Jeannine Grimalt Ferriol,. In accordance with the applicable regulations, the guide holds professional tour guide licence no. GTOIB-2193 issued by the Consell de Mallorca, Government of the Balearic Islands. By placing an order for a service, the client declares that they accept the following provisions. Placing an order constitutes the client's full and unconditional acceptance of these general terms and conditions of sale, as well as confirmation that the client has the full legal capacity required to enter into an agreement under these terms.

These General Terms and Conditions of Sale may be amended at any time, provided that any amendments are published on the website www.janinguidemallorca.com. The General Terms and Conditions are available at all times on the website and may also be provided to the client upon request.

General terms and conditions of sale

1. REQUEST AND BOOKING
A guided tour may be requested via the pre-booking form available on the website at the following address: https://janinguidemallorca.com/Contact

The pre-booking form does not constitute a commitment on the part of the guide to provide any service. It is simply a request for a quotation. Following a booking request, Jeannine Grimalt Ferriol undertakes to provide the client with a detailed quotation by email within 24 hours of receiving the request (on working days). The service will only be confirmed once the client has accepted the quotation and has been provided with the relevant information concerning the itinerary.

2. PRICES
The price stated in the quotation covers only the guided tour service, unless otherwise specified in the quotation. Only the services expressly included in the quotation are covered by the stated price. Prices may be changed at any time. However, services will always be charged according to the quotation issued and accepted by the client. Price information displayed on www.janinguidemallorca.com is provided for information purposes only. All prices are expressed in euros (€) and include 21% VAT (IVA).

3. PAYMENT TERMS
Payment may be made by bank transfer or in cash. Payment for the guided tour must be made in full, no later than 2 days before the scheduled start date of the service. Once payment has been received, Jeannine Grimalt Ferriol will send the client a confirmation email summarising all the information necessary for the guided tour. Jeannine Grimalt Ferriol shall not be required to provide the guided tour if full payment has not been received in accordance with the conditions set out above. Exceptionally, for bookings made less than 48 hours before the scheduled start of the tour, payment may be made in cash on site. The provision of the guided tour remains subject to receipt and acceptance of the quotation and acceptance of these general terms and conditions of sale.

4. CANCELLATION AND REFUND POLICY
If the client cancels the service after the booking has been confirmed, the following refund conditions shall apply:

• Cancellation made more than 7 DAYS before the start of the service: the booking will be refunded in full (100%)

• Cancellation made less than 48 HOURS before the start of the service: the full amount will remain due and no refund will be possible

• Refunds will be made by bank transfer within 7 days of receipt of the cancellation request and once the client has provided the necessary bank details

• If the guide cancels the service, Jeannine Grimalt Ferriol undertakes either to provide a full refund or to offer the client the possibility of rescheduling the tour for a later date

• If the tour cannot take place for a reason beyond the guide's control, such as the closure of a site due to weather conditions, strikes at a museum or visited site, exceptional closure, or similar circumstances, the appropriate solution will be considered on a case-by-case basis. This may include a partial or full refund, rescheduling the tour, or modifying the original tour

• The client shall not be entitled to claim any additional compensation for any failure to provide the service resulting from such circumstances

5. TOUR CONDITIONS
The guide undertakes to be present at the date, time and meeting point agreed upon at the time of booking. The client is responsible for ensuring that they are present at the agreed date, time and meeting point at the scheduled start of the tour. In the event of a delay by the client, the guide undertakes to wait for a maximum of 30 minutes after the agreed starting time. The duration of the tour cannot be extended due to a delay on the part of the client. If the client fails to attend the tour and does not contact the guide within 30 minutes of the scheduled start time, the tour will be considered cancelled and no refund will be possible. Guided tours will take place in rainy weather.

6. LIABILITY
During the tour, participants remain responsible for their own personal safety and civil liability. Jeannine Grimalt Ferriol  cannot be held liable, in particular, for:

• Theft or loss of personal belongings or valuables belonging to the client or participants

• Personal injury or material damage suffered by the client or participants during the service

• Any direct or indirect damage, of whatever nature, that the client or participants may cause to other participants or third parties

• Any damage caused by the client or participants to museums or other sites visited during the tour

7.APPLICABLE LAW AND JURISDICTION
These general terms and conditions of sale are governed by Spanish law. Any dispute relating to the sale or provision of the Services shall be subject to the jurisdiction of the courts of Palma de Mallorca, Spain.
